Duty of Disclosure

What you must tell us?

When answering our questions, you must be honest and you have a duty under law to tell us anything known to you, and which a reasonable person in the circumstances, would include in their answer to the question. We will use the answers in deciding whether to insure you and anyone else to be insured under the policy, and on what terms.

Who does the duty apply to?

It is important that you understand you are answering our questions in this way for yourself and anyone else that you want to be covered by the policy.

What happens if you fail in your duty?

If you do not answer our questions in this way, we may reduce or refuse to pay a claim, or cancel the policy. If you answer our questions fraudulently, we may refuse to pay a claim and treat the policy as never having existed.

  • Will anyone apart from you be driving this car repeatedly?Help

    Who drives this car
    Close help

You must tell us about everyone (excluding learner drivers) who will drive this car repeatedly.

By repeatedly, we mean anyone you know or expect to use the car regularly, or only from time to time, during the period of insurance. If other people drive this car repeatedly or from time to time, you’ll be able to list them later in this quote.

If you need to let someone else, who you are not aware of today, drive the car, we will cover them subject to the terms of your policy. Please read the PDS for details.

One of the important factors your premium will be based on will be the drivers you list, including their age, gender and driving history. AAMI is obligated to insure all drivers correctly. Not telling us about a repeat driver could result in your claim being reduced or not paid, a higher claim excess, or your policy being cancelled.
