1. Introduction
1.1. AAMI Driver Rewards (‘Program’) is operated by AAI Limited ABN 48 005 297 807 trading as AAMI (‘we’, ‘us’), in conjunction with third party technology supplier (‘Technology Supplier’).
.2. Your use of Program is subject to and indicates your acceptance of these Terms and Conditions and is also subject to the AAMI App Terms and Conditions. From time-to-time competitions or offers may be available in association with Program use, and you will be notified of any additional terms and conditions that apply to them.
2. Eligibility and use
2.1. Program is available to all AAMI App users, but users must have an active eligible AAMI policy linked to the AAMI App to gain access to retailer cashback offers based on their driving score (see condition 4 below for Program Offers Rules).
2.2. Your use of Program is voluntary. You can opt out of the Program at any time in the settings of the AAMI App, but you will not be eligible for incentives or special offers when it is not active.
2.3. Program requires that your phone’s Location Services, and Motion and Fitness Data are enabled to operate. For some devices, enabling Bluetooth may also be required.
2.4. Program is solely for bona fide personal use and must not be used for any commercial purpose.
2.5. You must not:
2.5.1. reverse engineer Program or associated technology or use either in a service provider capacity;
2.5.2. use Program to store or transmit infringing, libellous or otherwise objectionable, unlawful or tortious material, or to store or transmit material in the violation of third-party rights;
2.5.3. interfere with or disrupt the integrity or performance of Program
2.5.4. attempt to gain unauthorised access to Program or related systems or networks; or
2.5.5. access Program to build a competitive service or product, or copy any feature, function or graphic for competitive purposes.
2.6. You agree:
2.6.1. to keep your AAMI App password used to access Program secure and confidential;
2.6.2. that you are solely responsible for your data and driving activity captured by Program;
2.6.3. to use reasonable efforts to prevent unauthorised access to your account, including keeping your AAMI App password secure, and to notify us if you become aware of any unauthorised access; and
2.6.4. that you may only use Program in accordance with these Terms and Conditions and applicable law.
2.7. You are granted a non-exclusive, revocable licence to access and use Program until terminated. We may terminate your access to Program if we determine with reasonable grounds that your use of the service involves tampering, dishonesty or other conduct in breach of these Terms and Conditions. Following termination, you may not directly or indirectly use or access Program.
3. Information handling
3.1. We collect and use information about your accelerating, braking, cornering, phone distraction and speed through Program’s smartphone telematics technology (which includes use of location information).
3.2. This information and related data analytics are used:
3.2.1. to provide the Program service, including calculating your driving score and determining associated offers (if applicable);
3.2.2. for our product and service research and development; and
3.2.3. to make special offers from time to time.
By using Program, you consent to this collection and use. Your Program information and data analytics will not be used to make any decisions about an insurance policy you hold with us or any claims you may make.
3.3. Your user identification number and email address will also be shared with Technology Supplier to facilitate the service.
3.4. For users who link a card to access Program’s retailer cashback offers (see condition 4) we will share your user identification number with Mastercard Asia/Pacific Pte Ltd ABN 53 143 050 043 (‘Mastercard’) to enable offer access and redemption, but the card details you enter are not collected by us. They are encrypted and stored securely by a card vault service to enable monitoring of transactions asdetailed in the Program Offers Rules (condition 4). Mastercard may retrieve and analyse transaction data for up to 13 months prior to your card linking for the purpose of targeting and assigning personalised marketing offers.

4. Program Offers Rules
4.1. To access the Program’s suite of retailer cashback offers (‘Offers’) you must:
4.1.1. hold and link an active eligible AAMI personal insurance policy in the AAMI App (the following are not eligible policies: QLD and SA Compulsory Third Party, Business/Commercial Insurance, Health Insurance, Life & Income Insurance and Pet Insurance); and
4.1.2. hold a Program driving score of 85 or above (checked on the 1st calendar day of each month).
If you are eligible on the 1st of the month, available Offers will be unlocked for that month for activation.
4.2. To receive the Offer cashback, you must:
4.2.1. ‘activate’ the Offer in the AAMI App via the ‘Rewards tab’;
4.2.2. have linked a current Australian Mastercard or Visa card, which you will be prompted to do upon activating your first unlocked Offer. This linking will allow your card network (Mastercard/Visa) to notify Slyp Pty Ltd of qualifying transactions on your card to facilitate offer cashback to that linked card. After linking your card for the first time, it can take up to 24 hours to be able to activate Offers. Mastercard (for Mastercard cards) or Slyp Pty Ltd (for Visa cards) will monitor activity on your card to determine when you have made an eligible purchase to enable the cashback to that linked card; and
4.2.3. make an eligible purchase from the participating retailer using the linked card during the Offer period.
4.3. The Offer is for the original recipient and cannot be shared or forwarded. Payment must be made within Australia in AUD and directly to the merchant via your linked Australian card and not via third-party payment providers such as PayPal, Afterpay etc.
4.4. Offers are subject to expiry dates set by the individual retailers and notified to you in the AAMI App. Access to an Offer will end on the notified expiry date, or if you no longer meet the eligibility requirements listed in condition 4.1.1.
4.5. Any purchases you make to redeem an Offer are subject to the retailer’s terms and conditions, including those disclosed on the Offer details screen in the AAMI App.
4.6. Duration between retail purchase with linked card and cashback may vary based on retailer policies (generally within 14 business days). Successful cashbacks will be shown in your linked card account as “AAMI Driver Rewards”.
4.7. Listing of Offers and the issue of cashback is facilitated by Mastercard. We do not collect or have access to your linked card information, and cashback details listed in the AAMI App from monitored transactions are displayed by Mastercard.
4.8. You are responsible for checking the accuracy of your trip data and trip classification to ensure it has accurately identified your driving trips, and to exclude any incorrectly classified trips. We are not responsible for any score impacts or Offer eligibility missed due to incorrect trip recording.
4.9. The Program requires that your phone’s Location Services, and Motion and Fitness Data are enabled correctly to operate and capture trips to calculate eligibility for Offer access. If these permissions are not enabled, you will not be eligible for Offers.
4.10. To opt out of Program Offers, you must login to the AAMI App and delete all linked cards displayed on the 'Linked cards' screen. This request may take up to 48 hours to be processed.
Opting out will terminate your eligibility to redeem Offers associated with the Program and purge all associated transaction data.
4.11. If you have a pending cashback and delete your card from the Program, then cashback cannot be credited to your account, even though it may be listed on your ‘My cashback’ screen. It takes up to 3 business days for the transaction to be displayed in ‘My cashback’ but up to 14 business days for transactions to be credited to your account.
4.12. If you do not access and/or use the Program Offers for a period of 12 consecutive months, you may be opted out from Program Offers and any linked cards may be unlinked. You can opt back in at any time by linking a card again.
5. General
5.1. While reasonable steps have been taken to ensure that information is free from error, subject to any applicable law which cannot be excluded (including warranties under the Australian Consumer Law), we do not guarantee the availability, accuracy, or performance of the service and any warranties not expressly provided in these Terms and Conditions are excluded.
5.2. Subject to any rights you may have under any applicable law (including the Australian Consumer Law) we, our related bodies corporate and Technology Supplier exclude all liability for any loss suffered or incurred in connection with your use of the Program, including any indirect, consequential, incidental, or special damages (including lost profits and loss or destruction of data). To the extent that such liability cannot be excluded by, it is limited to the minimum allowable by law.
5.3. We or Technology Supplier (as applicable) retain all intellectual property rights in Program and associated technology, and no rights, title or interest is transferred to you.
5.4. You agree that Program and associated technology are our and Technology Supplier’s confidential information and may only be used as set out in these Terms and Conditions.
5.5. You agree that a breach of these Terms and Conditions or violation of the intellectual property rights granted under them may cause irreparable harm and we or Technology Supplier may seek an injunction against you to avoid any future breach.
5.6. We reserve the right to amend, suspend, or discontinue the Program at any time and for any reason, and to amend these Terms and Conditions to reflect updates or changes to the Program by publishing and notifying you of the varied Terms and Conditions.
