What is public liability insurance?
Public Liability Insurance helps cover your business if a customer, supplier, or member of the public is injured, or their property is damaged, as a result of your business activities. It can cover legal costs and compensation claims if your business is found to be at fault—whether you're working on-site, at a client’s premises, or from your own workplace.
This type of insurance is especially important for businesses that interact with the public, operate in physical locations, or work on third-party sites.
All AAMI Business Insurance products have a combined Public and Products Liability cover. Both Public and Products Liability provide coverage for third party injury or property damage that you might cause. The difference is that Public Liability relates to injury to a person or damage to a person’s property that you cause whilst you’re on the job, and Products Liability relates to injury to a person or damage to their property caused by any products you distribute, supply or manufacture.
AAMI Business Insurance does not offer separate Public Liability Insurance or Products Liability Insurance (except on market stall policies). Instead, our Public & Products Liability Insurance provides combined coverage for both, offering broader protection under a single policy.
Public Liability Insurance is generally not compulsory for most businesses in Australia – but it is important for any business that interacts with clients, customers, or the general public.
However, in certain industries or situations, Public Liability Insurance may be required by:
- licensing bodies or regulators (e.g. some trades or contractors)
- landlords or property managers if you're leasing a commercial space
- event organisers or councils if you’re operating a stall, stand, or providing services at public events, or
- clients or commercial contracts that specify minimum liability cover before work begins.
Even if it’s not a legal requirement, having Public Liability Insurance can help provide cover for your business from costly claims involving third party injury or property damage.
Each business is different, and as such has different needs when it comes to insurance. However, in making the decision you may want to take into account the following factors:
The contracts you work on. Some contracts will stipulate the minimum amount of cover required. If your business is within a shopping centre, you may find that the contract stipulates a minimum of $20m cover is required
The conditions of your licence (if applicable). As an example, electrical contractors are required to hold a minimum of $5 million public liability cover in order to obtain their licence in some states.
AAMI can offer limits of $5m, $10m, and $20m cover, which can be purchased online or via our Australian-based Call Centre on 1300 176 698.
No two businesses are the same and neither are two Public Liability Insurance premiums. The quickest way to get an insurance quote for your business is by going online.
Some scenarios which are not covered by Public and Products Liability Insurance include:
- Injury to your employees (this is typically covered via Workers Compensation Insurance),
- Civil legal liability incurred as a result of your professional advice (this can be covered via Professional Indemnity),
- Pollution,
- Asbestos, and
- Product recall.

Public Liability Insurance provides cover for claims made against your business, but it does not automatically extend to subcontractors, unless they’re specifically named on your policy or included in your cover.
Subcontractors are usually considered separate businesses and are generally expected to have their own Public Liability Insurance. If a subcontractor causes injury or property damage while working under your direction, your policy may not cover the claim unless it explicitly includes them.
It’s always a good idea to:
- check your Product Disclosure Statement and Policy Wording to confirm who is covered, and,
- request proof of insurance from subcontractors you engage.
